Who provides the service

E-BACKUP is provided by ATG Soluções, located at R. Dr. Diogo de Faria, 55, Vila Clementino, São Paulo, SP, Brazil. By creating an account or using the service, you accept these terms and the privacy policy.

The service

E-BACKUP copies files, disk images, databases and network shares from the machines where the agent is installed, and keeps the copies in storage in the chosen region. Data is encrypted on the machine, before it is sent. Administration, searching restore points and restoring are done in the web console.

Account and access

• Two-step verification is required to sign in to the console.
• You are responsible for keeping your credentials safe and for what the users you invite do with the access you give them.
• If you suspect unauthorized access, change your password and tell support.

Free trial

The free trial lasts 30 days and allows up to 100 GB of storage and 5 machines. These values may be adjusted; the ones that apply to your trial are shown at sign-up.

• One trial per person and per e-mail address.
• No charge and no credit card.
• When the trial ends, backups stop. Restoring and downloading remain available for 15 days.
• After that, the organization is closed and the data is deleted within 30 days.
• To continue as a customer, talk to the sales team; the account and the backups stay as they are.

Acceptable use

You may not use the service for the purposes below. An account that does may be suspended.

• storing or distributing illegal content;
• storing or distributing malicious software;
• attacking or harming third parties;
• trying to access other customers' data or accounts;
• overloading the service on purpose.

Customer data

• You are the controller of the data you copy; we process it on your behalf, as processor, under these terms and the Brazilian data protection law (LGPD).
• We do not access the content of the backups: it reaches the server encrypted.
• Data stays in the chosen region.

Availability

We make a reasonable effort to keep the service available and announce planned maintenance whenever possible.

The free trial is offered as is, with no service level guarantee.

Liability

• Backup is one layer of protection, not the only one: test restores regularly and keep more than one copy of what is critical.
• For the paid service, our liability for damages is limited to the amount you paid in the 12 months before the event.
• For the free trial, we are not liable for data loss.

Termination and export

While the account is active, you can restore or download your data from the console at any time. Do it before the end: in the trial the periods above apply, and when a contract ends the organization is closed and the data is deleted within 30 days.

Changes to these terms

When these terms change, the version date at the top of the page changes with them. Customers are notified by e-mail.

Governing law and venue

These terms are governed by Brazilian law. The courts of the city of São Paulo, SP, Brazil, have jurisdiction.
